A. Instructions on Withdrawal
Introduction
Consumers are entitled to a right of withdrawal according to the following stipulation, where a consumer is any natural person who enters into a legal transaction for purposes which can predominantly be attributed neither to their commercial nor their independent professional activities:
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (Nano-Venture GmbH & Co. You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Premature Expiration of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal does not apply to contracts for the delivery of goods whose price depends on fluctuations in the financial market over which the entrepreneur has no influence and which may occur within the withdrawal period.
Linked/Financed Transactions
If you finance this contract through a loan and later withdraw from it, you are also no longer bound by the loan contract, provided that both contracts form an economic unit. This is particularly to be assumed if we are simultaneously your loan provider or if your loan provider makes use of our cooperation with regard to financing. If the loan has already been received by us at the time the withdrawal becomes effective or the goods are returned, your loan provider in relation to you enters into our rights and obligations from the financed contract. The latter does not apply if the present contract involves the acquisition of financial instruments (e.g., securities, foreign currencies or derivatives). If you want to avoid a contractual obligation as far as possible, exercise your right of withdrawal and also withdraw from the loan contract if you also have a right of withdrawal for this.
General Notes
1) Please avoid damage and contamination of the product. Send the product back in original packaging with all accessories and with all packaging components to us. If necessary, use protective outer packaging. If you no longer have the original packaging, please provide suitable packaging for adequate protection against transport damage.
2) Please do not return the goods freight collect.
3) Please note that the aforementioned points 1-2 are not conditions for the effective exercise of the right of withdrawal.
